This Privacy Policy explains what personal information we collect, how we use and share it, the choices you have, and the rights you may exercise under California, U.S. federal, and other applicable privacy laws. It applies to use of this private rental site and the underlying Upcar Private platform, and it explains how signing up here also creates a linked Upcar account and shares your information between the two platforms.
1. Scope of This Policy
This Privacy Policy applies to personal information we collect through this private rental site, the Upcar Private platform, our mobile experiences, and any related communications. It explains the categories of personal information we collect, the sources of that information, the business and commercial purposes for which we use it, the categories of recipients with whom we share it, and the rights you have. By using the platform, you acknowledge that your information will be handled in accordance with this policy.
2. Linked Upcar Account and Cross-Platform Data Sharing
This private rental site runs on the Upcar Private platform operated by Upcar, Inc. ("Upcar"). When you sign up on this site, a corresponding Upcar account is created at the same time and the two accounts are linked. As a result, the personal information you provide and that we collect — including your name, contact details, date of birth, government-issued ID and driver-license data, profile photo, payment and payout details, identity- and driver-verification results, booking and trip history, messages, and ratings — is shared between this site and Upcar, and each may act as a recipient and, where applicable, a controller of that information for the purposes described in this policy (such as account management, verification, fraud prevention, payments, customer support, legal compliance, and improving the services). We obtain your explicit consent to the creation of the linked Upcar account and to this cross-platform sharing at the time you sign up, before your account is created. You may withdraw consent by closing your account, subject to the retention obligations described in the "Data Retention" section; withdrawing consent will end your ability to use the platform. This sharing is in addition to, and operates alongside, the disclosures described in the "How We Share Information" section below.
3. Information You Provide
We collect information you provide directly, including your name, date of birth, email address, phone number, mailing or billing address, government-issued ID and driver license images, profile photo, payment method details (handled by our payment processors), vehicle and listing details for hosts, messages exchanged with other users and support, ratings and reviews, and any other information you choose to share. Some information is required to use specific features (for example, identity verification before booking).
4. Information Collected Automatically
When you use the platform, we automatically collect technical and usage information, including IP address, device identifiers, browser type and language, operating system, time-zone, referrer URLs, pages and screens viewed, actions taken, time on page, crash and diagnostic data, and approximate or precise location (with your permission). We use cookies, mobile SDKs, and similar technologies to operate, secure, and improve the platform; to remember your preferences; to keep you logged in; and, with your consent where required, to measure marketing performance.
5. Information from Third Parties
We receive information from third parties such as identity, fraud, and driver-record verification providers; payment processors and card networks; insurance and claims partners; toll authorities and parking-violation processors; analytics and marketing partners; social-login providers (if used); and law-enforcement or regulatory bodies in response to lawful requests. We may also receive information from referring hosts or affiliates that connected you to the platform.
6. How We Use Information
We use personal information to (a) create and maintain your account and verify your identity; (b) process bookings, payments, refunds, payouts, holds, and post-trip charges; (c) facilitate communications between hosts and renters and with our support team; (d) provide customer service, respond to inquiries, and resolve disputes; (e) prevent fraud, abuse, and unauthorized activity, and to enforce our terms; (f) comply with legal, tax, accounting, audit, and regulatory obligations; (g) personalize and improve the platform, including testing new features and measuring performance; and (h) send transactional and, with appropriate consent, marketing communications.
7. How We Share Information
We share personal information with: (a) Upcar and the linked Upcar account described above, so that your identity and activity are consistent across both platforms; (b) hosts and renters as needed to facilitate trips (for example, name, profile photo, and trip details); (c) service providers that help us run the platform (cloud hosting, analytics, customer support tooling, identity verification, fraud prevention, communications); (d) payment processors and financial institutions to process payments and payouts; (e) insurance and claims partners; (f) law enforcement, regulators, courts, or other parties when we believe disclosure is required by law or necessary to protect rights, property, or safety; and (g) corporate counterparties in connection with a financing, merger, acquisition, or similar transaction. We do not sell personal information for money. We may share certain online identifiers and usage information with advertising and analytics partners; you can opt out as described below.
8. Cookies, Analytics, and Tracking
We and our partners use cookies, pixels, mobile identifiers, and similar technologies to make the platform work, remember your settings, measure performance, and (where you have consented) personalize content and ads. You can manage cookies through your browser or device settings, and where required by law we provide an in-product cookie preference control. We honor Global Privacy Control (GPC) signals as a valid request to opt out of cross-context behavioral advertising for the browser sending the signal.
9. Data Retention
We retain personal information for as long as necessary to provide the platform, to comply with legal, tax, accounting, audit, and risk obligations, to resolve disputes, to enforce agreements, and for legitimate business purposes such as fraud prevention. Retention periods vary by data type and context; for example, transaction records and identity-verification data are typically retained for several years to comply with financial and regulatory requirements. When personal information is no longer needed, we delete or de-identify it in accordance with our retention schedule.
10. Security
We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction, including encryption in transit, restricted access controls, logging and monitoring, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please use a strong, unique password, keep it confidential, and contact us immediately if you suspect any unauthorized use of your account.
11. Your Choices
You can review and update most account information from your profile settings, and you can request account deletion in accordance with applicable law. You can opt out of marketing emails by using the unsubscribe link in any marketing message or by contacting support; you cannot opt out of essential transactional messages while you have an active account. You can adjust device location and notification permissions in your operating system or browser settings. Disabling certain features may limit functionality (for example, identity verification is required for booking).
12. California Privacy Rights
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the CPRA, gives you the right to: (a) know what personal information we collect, use, share, and disclose; (b) request deletion of your personal information, subject to certain exceptions; (c) correct inaccurate personal information we maintain about you; (d) opt out of the sale or sharing of personal information for cross-context behavioral advertising; (e) limit the use and disclosure of sensitive personal information; and (f) be free from retaliation for exercising your rights. To exercise these rights, email privacy@upcar.ai. We will verify your request and respond within the time required by law (generally 45 days).
13. Children's Privacy
The platform is not directed to children under 18, and we do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a child under 18 without verifiable parental consent, we will delete that information. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.
14. International Users
The platform is operated from the United States. If you access the platform from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States and other locations where our service providers operate. By using the platform, you consent to such transfers, which may be governed by laws that differ from those in your country of residence.
15. Changes to This Policy
We may update this Privacy Policy from time to time. If we make a material change, we will notify you by email or by posting a prominent notice on the platform. The "Last Updated" date at the top of this policy indicates when it was last revised. Your continued use of the platform after the effective date of the change constitutes acceptance of the updated policy.
16. Contact Us
